hey, you'd better talk to immigration lawer, cuz now, the classes are started already, which means your I-20 will be issued only for the next(spring semester), but if you apply for F1 visa, and you will not be able to have your J1 valid not earlier than a month prior the classes start, your F1 visa will be definitely denied:-(
Sounds like you have to either go back to your home country and try to do it from there..which is hard..or find a good immigration lawyer here, and probably go thru other visa (like B2) just to cover the gap between the end of J1 and the beginning of the F1....unless as I said your college actually issues your I-20 for this semester, then you are good to go..just apply for the change of status(I-539) but !WATCH THE TIME!!!
I think I saw some other ppl,who deal with the same problem, so they probably know better than I do..

Thanks for the answer!!!!!I already have immigration layer,and he said that my I-20 is issued for this semester,but i'm not sure that he tells me the truth.cause i think he tries to make me pay him first,and than just tell me that he can do nothing about my case.There where i came from,i'm used not to trust anyone.So,I'm not a full time student for this semester yet,but my classes of English in the same colledge will start on october the 20.Although i will be a full time student on spring fall.So,i hope everithing will be o.k.,cause my layer told me that as long as i'm in the prosess of getting a new status(i mean from the moment i applyed for another visa),even if my J1 visa expires,it is not a violation of federal law and i can remain in the coutry untill i will get a final answer from the embassy.I don't know to trust him or not.But the question that really bothers me is that:is it really possible to change J1 to F1,here in usa,not going back to get it in my "MOTHERLAND" country???Cause in the embassy in my country,they told me it's impossible.
Hope someone knows the answer!!!! Confused

firstly, you should check the date the classes start on your I-20.it is easy if you actually see the document. if it is true and the I-20 is issued for this semester, then you'll be fine,except you will not probably be able to start classes this fall, due to delays in obtaining the visa process, but at least you'll be fine with the time frame; but if it is only for the spring semester(for example-01/15/07)then you are in trouble.
secondly, check the day when your J1 expires. it is true that you can remain in the country during the visa process, but if your visa is valid till the end of the september, but classes start(in your I-20)in january next year, you still be able to be here, until the final desicion, but it certainly will be the denial. because as i said, your F1 could be open not earlier than a month, before the classes start, which means you have to have a valid visa until the critical date the visa can be issued. this is the problem, not the remaining while the process is taking place.
I myself have been dealing with the immigration quite long enough to understand that the best way to do stuff is the way american governemnt wants you. But, if you are from belarus or ukraine, for example, it will be probably impossible for you to obtain visa after getting back to your homecontry. And I'm sure there are a lot of succesful stories abt changing the visa status w/t coming back. How come by the way, that your college adviser doesn't help you at all? that is trange, he should have at least given you the information abt the change of status.

You are right,BTW, that you are very careful with your layer. Double check everything and search for some more inf on-line...

Thank you,i appreciate your help.I hope i'll be O.K.Still nobody can tell you for certain the exact answer,so i will be waiting untill i will get more information from my loyer.Anyway thanks a lot!!!!!Probably i will need some more information later,so how can i call you,or can you give me your e_mail???

hey, could you tell me where you applied for f-1 visa? do you need to go to the embassy or what? i'm planning to do it next summer, so it'd be really nice to find out what i should do. thank you in advance.
